(ContentDesk) September 22, 2005 -- In this seminar, you will learn the distinction between the Individuals with Disabilities Education Act (IDEA) of 2004 and Section 504 of the Rehabilitation Act, the two federal laws that govern the education of students with disabilities. Additionally, you will learn about the interplay between California law and these two statutes.
The presenters will provide you an overview of the requirements of special education law and Section 504, point out the areas that are most commonly challenged at due process and give practical suggestions regarding how to avoid costly litigation.
You will also be given an opportunity to review sample scenarios and be guided through the practical application of the law.Van T. Vu is an associate in the Schools and Special Education Practice Group of Best Best & Krieger LLP.
Ms. Vu's practice focuses on the representation of educational entities such as school districts, county offices of education and special local plan areas in litigation, administrative proceedings and mediations involving special education, Section 504 of the Rehabilitation Act, student discipline, personnel discipline and removal, and discrimination. She has experience in providing training to educators and administrators regarding various aspects of special education law and student discipline.
Prior to joining the firm, Ms. Vu was a senior hearing officer at the Institute for Administrative Justice, where she conducted special education due process hearings for the state of California and administrative hearings for the city of Sacramento.
As an administrative hearing officer for almost seven years, she convened over 150 hearings, wrote approximately 60 decisions and over 500 orders, and held over 24 pre-hearing conferences. Ms. Vu's special education decisions have been affirmed by a California Superior Court, the U.S. District Court - Central District of California and the 9th Circuit Court of Appeals. Additionally, she was involved in the initial and ongoing training of hearing officers in special education law and administrative procedures, and the review of hearing officer decisions and orders.
Prior to working as a hearing officer, she was a mediator and case developer for four years with the Davis Community Mediation Service, where she assisted parties in resolving consumer/merchant, tenant/landlord, employer/ employee and interpersonal disputes. Ms. Vu's extensive hearing officer and mediator experience makes her especially qualified to consult with educational clients on ways to prevent and avoid costly litigation. She received her LL.M. degree in government and public policy from the University of the Pacific's McGeorge School of Law.
Ms. Vu also received her J.D. degree and a certificate in governmental affairs from McGeorge School of Law, during which time she was a member of the Roger J. Traynor Honor Society.
She attended the University of California at Davis for undergraduate studies and earned her B.A.
degree in three subject areas: psychology, sociology and political sciences.
While at UC-Davis, Ms. Vu served on the Campus Judicial Board, where she conducted administrative hearings regarding academic and social misconduct at the university. She is a member of the Sacramento County Bar Association, the California Bar Association and the American Bar Association.Martin F. Fine is a partner of Best Best & Krieger LLP in the Sacramento office.
He has been practicing school and public agency law since 1987. Mr. Fine was most recently general counsel to the Sacramento City Unified School District, where he advised board members and administrators on legal matters, conducted litigation and administrative proceedings, and developed conflict resolution programs. His law firm background includes practicing public agency and school law at both Kronick, Moskovitz, Tiedemann & Girard and Lozano, Smith, Smith & Woliver, where he focused on personnel, special education, constitutional issues, business, labor relations and employment litigation. Mr.
Fine has experience in all aspects of labor relations, including negotiations with employee representatives; grievances and arbitrations; and proceedings before the Public Employment Relations Board, such as impasse, fact finding and unfair labor practice charges. In addition, he is a certified trainer in interest-based bargaining techniques in reduced litigation and improved relations between employees and management. Mr.
Fine has been an adjunct faculty member for California State University at Sacramento, the University of California at Davis-Common Ground and the University of San Francisco, providing graduate level instruction in the areas of education law, family law, and law and ethics for psychologists and counselors. He has been a seminar trainer and presenter in a large array of topics ranging from public agency law, constitutional issues, employment and labor relations.
Mr. Fine attended McGeorge School of Law and received his J.D. degree. He also possesses a master's degree in counseling education from California State University at Sonoma and a B.A. degree from the University of California at Santa Cruz.
Mr. Fine is a certified trainer in negotiations and advanced mediation, which he studied at Harvard Law School.
